Drunk Driver Falls From Roof

The Appleton Police Department arrested an Appleton man for his third OWI, after he fled on foot from a late night traffic stop.

On February 8, 2018, at 11:33 PM, an Appleton Police Department officer responded to a disabled vehicle call on the corner of E. Marquette Street and N. Union Street.  When he arrived at the scene, two people quickly entered a truck and sped away from the intersection.  The officer followed the vehicle for a short distance before it stopped.  The driver of the vehicle exited the vehicle and ran through a yard.  The passenger stayed in the vehicle.

Officers responded to the area to look for the driver.  An officer found the driver laying on the garage roof of a residence in the 400 block of E. Lindbergh Street. The officer was giving verbal commands to the subject, when the suspect got up and climbed to the peak of the roof.  He refused to follow the officer’s commands. While navigating the opposite side of the roof, away from officers, the suspect fell off the roof to the ground.  Officers then took him into physical custody.

The driver complained of back pain and was taken to a local hospital for examination. Prior to transport, the driver was found to be in possession of a baggie of marijuana. Officers conducted field sobriety tests on the driver at the hospital.  He failed the tests and was arrested for his 3rd offense of Operating While Intoxicated.

Kyle J. Davis (M/W, 05/07/91), an Appleton resident, was confined at the Outagamie County Jail. Charges of Eluding, Resisting Arrest, 3rd Offense OWI and Possession of Marijuana are being requested.  Davis is also held on a probation violation. 

The passenger in the vehicle, a 30 year-old Menasha man, was issued a city summons for the marijuana in his possession at the time of the stop.  He was released after speaking to officers.
